This Event may involve serious risk of injury. I understand that by signing this Release, I am giving up the right to sue if I am injured while participating in this Event. Parents/Guardians of minors under 18 must sign this Release on behalf of the minor.
NAME OF EVENT: MD Turbines Foundation 2nd Annual Veteran’s Day Fundraiser and Relay Challenge
DATE: November 6, 2021
WHEREAS, as a participant, volunteer, contractor, affiliate, or invitee of MD Turbines Foundation, Inc. (the “Foundation”), I have the opportunity to participate in the above-referenced event on the above-reference date (hereinafter “Event”).
WHEREAS, I acknowledge that the Event is voluntary and attendance and participation is within my personal discretion. I acknowledge that my participation in the Event is a recreational activity and that my participation in it is voluntary. I understand that the participation in the Event carries with it inherent dangers and certain risks, including, but not limited to, personal injury or death. As a condition of such participation I attest as follows:
- I am aware of all the risks and dangers associated with participation in and any transportation to and from the Event. I acknowledge that by participating in the Event, I appreciate and assume these risks and any other risk that may arise during or be inherent to the Event. I acknowledge that I am solely responsible for my physical and mental fitness, and that I should consult a physician or other medical professional before engaging in physical activity such as and including the Event.
- I agree that the Foundation, its donors and volunteers, and other sponsors, and their respective owners, members, managers, board members, officers, employees, agents, affiliates, and contractors (hereinafter the “Released Parties”), shall not be legally responsible for any loss, injury, or damage resulting from any cause, including negligence of any party.
- I agree to assume all risks in connection with the Event including, but not limited to, risks associated with the location, route selection, weather, temperature, precipitation, any equipment I use, and any actions I may take while participating in the Event. To the fullest extent allowed by law, I agree to RELEASE, HOLD HARMLESS, COVENANT NOT TO SUE, AND INDEMNIFY the Released Parties from any liability for death, loss, injury, or other damage that may occur during or as a result of the Event or during transportation to and from the Event, whether foreseen or unforeseen, however caused and whether or not caused by negligence.
- I give permission to the Foundation to use my name, image, likeness, photograph, or any other record of my participation in the Event for any promotional purposes without compensation, reservation, or limitation.
- I am over the age of eighteen (18) years of age or I am a parent or legal guardian of a minor participating in the event. I have read the above prior to its execution, am familiar with the contents thereof, and have every right to contract in my own name, or on behalf of a minor, in this matter.
THE TERMS OF THIS AGREEMENT SHALL ACT AS A RELEASE AND ASSUMPTION OF RISK FOR MY HEIRS, EXECUTORS, ADMINISTRATORS, AND ALL MEMBERS OF MY FAMILY, INCLUDING MINORS. I UNDERSTAND THAT THIS IS A BINDING CONTRACT SUPERSEDING ANY OTHER AGREEMENTS OR REPRESENTATIONS AND IS INTENDED TO PROVIDE A COMPREHENSIVE RELEASE OF LIABILITY BUT IS NOT INTENDED TO ASSERT ANY DEFENSES THAT ARE PROHIBITED BY LAW. THE RIGHTS OF THE PARTIES VARY STATE-TO-STATE. IF ANY PART OF THIS RELEASE IS DEEMED UNENFORCEABLE, ALL OTHER PARTS SHALL BE GIVEN FULL FORCE AND EFFECT.
I HAVE CAREFULLY READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN THIS RELEASE AGREEMENT OF MY OWN FREE WILL.
